01Acceptance of These Terms

These Terms apply when you visit or use solarroseenergy.com (including the Free Solar Fit Energy Audit request page at solarroseenergy.com/start), sun.solarroseenergy.com (including our booking calendar), and any related pages, forms, emails, calls, and text messages from Solar Rose Energy (together, the "Services").

By using the Services, you agree to these Terms and to our Privacy Policy, which explains how we collect, use, and protect your information. If you do not agree, please do not use the Services.

In these Terms, "Solar Rose Energy," "we," "us," and "our" mean Solar Rose Energy LLC, a Colorado limited liability company doing business as Solar Rose Energy, operated by Amber Rose Castellon, Founder. "You" means the person using the Services.

02Who We Are

Solar Rose Energy is operated by Solar Rose Energy LLC, an independent energy dealership based in Colorado Springs, Colorado. We educate homeowners, run the Solar FitQuest discovery process, and, when a home is a good fit, coordinate with licensed, insured installation partners and financing or equipment providers who fulfill the project.

• We are not a utility. We do not generate, sell, or deliver electricity, and we do not set utility rates, net-metering rules, or interconnection requirements.
• We are not the installer of record. Installation, equipment, and financing are provided by independent third-party partners under their own agreements.
• Where we work: We currently serve homeowners in California, Colorado, Connecticut, Florida, Hawaii, Illinois, Maryland, Massachusetts, Nevada, New Jersey, North Carolina, Oregon, Texas, Utah, and Virginia. Availability of partners, products, programs, and incentives varies by state, utility, and home, and some homes or areas may not be eligible.

03Our Services and No Obligation

Through the Services, you can learn about solar, battery storage, EV charging, and related energy options; request a Free Solar Fit Energy Audit; and book an optional 15-minute Solar FitQuest Discovery call.

• No obligation. Submitting a form, requesting an audit, booking or attending a call, or replying to a message does not obligate you to purchase anything, sign anything, or continue working with us.
• Booking is optional. If you request an audit, we keep your request whether or not you book a Discovery call.
• No contract yet. These Terms are not a contract for solar equipment, financing, or installation. Any project happens only if you choose to move forward and sign a separate written agreement with the applicable installation, equipment, or financing provider. That agreement, not these Terms, governs the project, pricing, warranties, and performance.
• Free means free. The Free Solar Fit Energy Audit and Discovery call are provided at no cost to you.

We may change, pause, or discontinue any part of the Services at any time.

04Educational Content Is Not Advice or a Quote

Our pages, videos, calculators, bill examples, energy-plan illustrations, Solar Fit reports, and conversations are designed to help you understand your options. They are for general educational purposes only.

• Illustrations are not quotes. Bill examples, savings estimates, production figures, and energy-plan illustrations are not price quotes, offers, or guarantees of savings, production, or performance.
• Results vary. Actual costs, rates, incentives, tax benefits, production, and savings depend on your home, roof, shading, usage, utility, rate plan, equipment, financing terms, and programs that can change at any time.
• Not professional advice. Nothing we share is legal, tax, financial, or engineering advice. Please talk with a qualified tax professional about tax credits or incentives, and review any financing terms carefully before signing.
• Third-party data. Where we reference public data (for example, U.S. Energy Information Administration figures), it is provided as context and may not predict your future utility rates.

05Eligibility

The Services are intended for adults. You must be at least 18 years old to submit a form, book a call, or opt in to text messages. We do not knowingly collect information from anyone under 18.

If you share information about a home, please make sure you are the owner, a decision-maker for the property, or have permission to ask about it.

06Information You Submit

When you fill out a form, book a call, upload a bill, or send us a message, you agree that:

• The information you provide (such as your name, email, phone number, address, and bill details) is accurate, current, and your own, or you have permission to share it.
• The mobile number you provide for text messages belongs to you or you are its authorized user.
• You will let us know if your contact information changes, especially if you give up a phone number you used to opt in to texts.
• You will not submit anyone else's information without their permission, or submit false, misleading, or automated (bot) requests.

Please do not send Social Security numbers, bank account numbers, or credit-card numbers through our forms or by text. If a later financing or installation step requires additional information, that happens through the relevant partner and their own notices.

08Third-Party Partners, Providers, and Links

To help you explore and complete a project, we work with independent installation partners, equipment and monitoring providers, financing providers, and technology vendors (for example, the platforms that power our website, forms, calendar, and messaging).

• These partners are independent businesses, not employees or agents of Solar Rose Energy. We choose licensed, insured installation partners, but each partner is responsible for its own work, products, warranties, credit decisions, and compliance.
• If you move forward with a partner, their agreements, terms, and privacy notices also apply to you and to the information they receive.
• Our Services may link to or embed third-party websites, tools, and content (such as utility sites, government resources, maps, videos, or scheduling tools). We do not control and are not responsible for third-party content, availability, or practices. Visiting them is at your own discretion.

09Acceptable Use

Please use the Services respectfully and lawfully. You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose
• Submit spam, automated requests, or false information
• Try to interfere with, disrupt, scrape, or gain unauthorized access to the Services or our systems
• Copy, resell, or misuse our content or other users' information

We may decline, pause, or end access to the Services for anyone who misuses them.

10Intellectual Property

The Services and their content, including the Solar Rose Energy name and logo, Solar FitQuest, text, graphics, photos, designs, reports, and illustrations, are owned by or licensed to Solar Rose Energy and are protected by copyright, trademark, and other laws.

You may view and print content for your own personal, non-commercial use in evaluating energy options for your home. Please do not copy, modify, distribute, or use our content or branding for other purposes without our written permission. Third-party names and trademarks belong to their respective owners.

11Disclaimers

We work hard to keep our content accurate and helpful, but the Services are provided "as is" and "as available." To the fullest extent allowed by law, Solar Rose Energy disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not guarantee that the Services will be uninterrupted or error-free, that any home will qualify for solar, storage, financing, or incentives, or that any particular savings, production, rates, or results will be achieved. Warranties for equipment and installation, if any, come from the manufacturer or installation partner under their own agreements.

12Limitation of Liability

To the fullest extent allowed by law, Solar Rose Energy and its founder, team, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost savings, lost profits, or lost data, arising from or related to your use of the Services, our educational content, or the acts or omissions of third-party partners, providers, carriers, or websites.

Because the Services we describe in these Terms are provided free of charge, our total liability for any claim relating to the Services will not exceed one hundred U.S. dollars ($100). Some states do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits rights you have that cannot be waived under applicable law.

13Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be handled in the state or federal courts located in Colorado, unless applicable law requires otherwise.

Before filing any claim, we ask that you contact us first so we can try to resolve the concern informally. Most questions can be solved with a quick conversation.

14Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and change the "Last updated" date above. If we make a material change to how we send text messages, we will provide additional notice as required (for example, a site notice or a new consent request). Continuing to use the Services after an update means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it.
